This privacy notice for Faroverse, Inc. (d/b/a Faro) (“Faro,” “we,” “us,” or “our”), applies to our websites, mobile apps, and other digital services that link to this Privacy Notice (collectively, our “Services") and describes how and why we collect, store, use, and/or share (“process”) your information when you use our Services.

This Privacy Notice is incorporated into our Terms of Service, which also applies when you use our Services.

Please note that this Privacy Notice applies only to personal information collected in relation to our Services as described in this Notice. It does not apply to other personal information that you have provided to one of our customers, partners, or a third party. For more information on how these third parties may treat the personal information that you provide to them, please review their respective privacy notices.

1.   Personal Information Faroverse.ai Collects, How It Is Used & Shared

Information Collected

We collect information from and about the users of our services, including information by which you may be personally identified ("personal information") and we collect it in a variety of ways, as detailed below.

Personal Information You Provide:

This information is collected directly from you to provide our Services and communicate with you:

·      Phone number

·      E-mail address

·      Mailing address

·      Usernames and passwords for logging into our website

·      Date of birth

Personal Information Collected Automatically:

This information is collected through your use of our Services or Website.

·      Tracking Technology – We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, the browser you use, characteristics of your device and its operating system, language preferences, referring URLs, device name, country, general location, information about how and when you use our Services, and other technical information. This website uses analytics to view site traffic, activity, and other data. We do not use cookies to collect any information.

·      Device and Location Data - This Website and our Services collects personal information to power our site analytics, including:

o   ‍Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings.

o   ‍Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

How Personal Information Is Used

We may use your Personal Information for the following reasons:

o   Determining the effectiveness of promotional campaigns

o   Evaluating and improve our Services, products, marketing, and user experience

o   Informing you of any marketing specials

o   Promotion of our Services

o   For example, we may utilize your phone number if the Company is running any prize draws and competitions that may be beneficial to you. You can opt-out of receiving marketing text/SMS messages by replying “STOP” or via the user profile screen in our Services.

o   Contacting you in response to a customer service/support request

o   Sending administrative information to you

o   Personal Information may be used to comply with any legal requests from law enforcement, court orders, subpoenas, tax purposes, and to carry out the Company’s legal and contractual obligations.

How We Share Personal Information

We may share or disclose personal information with our business partners or service providers who act on our behalf to provide support or other capabilities for the Services, and who are under appropriate contractual obligations with us. We may also share or disclose your personal information in order to conduct our business and pursue our business interests, including in the following situations:

·      Corporate Changes or Business Transfers.

o   We may transfer information, including your personal information, in connection with a merger, sale, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy or other change of ownership or control by Faro or any affiliated company (in each case, whether in whole or in part). When one of these events occurs, Faro will use reasonable efforts to notify users before information is transferred or becomes subject to different privacy practices.

·      With Our Affiliates.

o   We may share your information with our affiliates. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.

·      With Our Business Partners.

o   We may partner with other companies to provide you with our Services. When you register for a co-branded website or service, your registration information may be shared with one or more of Faro’s business partners. Each business partner will have its own privacy policy, and its privacy practices may differ from this Privacy Notice.

·      Legal Requirements.

o   In certain circumstances, Faro may release your personal information in response to a court order, subpoena, search warrant, regulation, binding order of a data protection agency, governmental request or other legal or regulatory process. Faro may disclose information if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Faro and our customers or others.

Processing Location and International Data Transfers

Our servers are located in Japan. If you are accessing our Services from outside Japan, please be aware that your information will be stored and processed by us in our facilities and by those parties with whom we may share your personal information, in Japan.

Regardless of where your personal information is collected or processed, Faro maintains and requires its service providers to maintain appropriate administrative, technical, and physical safeguards to protect your personal information.

2.   Data Security and Storage

We implement reasonable technical and organizational security measures that are designed to help protect personal information from accidental or unauthorized access, use, loss, destruction, disclosure, or modification when transmitting or storing personal information. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.

Although we will protect your personal information as described in this Privacy Notice, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

Please note that by default Faro stores all personal information indefinitely.

3.   Your Privacy Choices

Your local privacy laws may grant you rights with respect to your personal information, and we will not knowingly discriminate against you because you have exercised any of your privacy rights. These rights may differ based on which local laws apply to you, but may include the rights to:

·      Withdraw consent: You may have the right to withdraw your consent to our processing of your personal information, where we process your personal information based on your consent. Withdrawing consent will not affect the lawfulness of any processing based on your consent prior to its withdrawal; we will however cease consent-based processing upon withdrawal.

·      Access/know. You may have the right to request a copy of the information we keep about you, and in certain circumstances to receive this in a portable format.

·      Delete/erase. You may request that we delete the personal information we keep about you.

·      Correct/rectify/update. You can correct most information you provide to us by editing your profile directly in the service. If you believe any other information we hold about you is inaccurate, you may contact us to rectify it.

·      Object/restrict. You may also have the right to object to or request that we restrict certain processing.

Please note that these rights are not absolutely guaranteed and there are several exceptions where we may not have an obligation to fulfill your request. We are only required to honor these rights to the extent we act as a controller of that data, and the requested rights have been granted and apply to you under applicable data protection laws. Please consult your local data protection laws to determine what rights may be available to you and when access to these rights is limited.

We may ask you to provide proof of identity before we can answer the above requests. Keep in mind, we may reject requests, including if we are unable to authenticate you, if the request is unlawful or invalid, or if it may infringe on trade secrets or intellectual property or the privacy or other rights of someone else. We may not be able to accommodate certain requests to object to or restrict the processing of personal information, notably where such requests would not allow us to provide our service to you anymore.

4.   Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems and mobile applications include a Do- Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected.

At this time, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy statement.

5.   Links to Other Websites

Some of our websites or interactive features may contain links to third-party websites or services that are not under our control or ownership. Such links do not constitute an endorsement of those third parties or the content displayed therein, and Faro is not responsible for the content of such websites.

We are not responsible for how these sites operate or treat your information. You acknowledge that we provide these links to you only as a convenience, and you understand if you decide to visit a third-party website or service, you are subject to its privacy practices and not this Privacy Notice.

We encourage you to carefully read the privacy policy or statement and other legal notices of each website or service that you visit.

6.   Children or Minors

Our Services are intended for use only by individuals who are 18 years old or older. We do not knowingly collect any personal information directly from individuals who have not reached the age of majority (minors).

Consistent with the requirements of the Children’s Online Privacy Protection Act (COPPA), if we learn that a child under age 13 has provided personal information to or through the Services, we will use that information only to respond directly to that child (or their parent or legal guardian) to inform the child that they cannot use the Services and subsequently we will dispose of such personal information in accordance with this Privacy Notice. We will also provide a copy of the personal information to the child’s parent or legal guardian prior to deletion.

7.   Changes to Our Privacy Notice

We may update this Privacy Notice from time to time. The updated version will be indicated by an updated effective date (the “Last Updated” date at the top of this Notice), and the updated version will be effective as soon as it is posted.

Any changes will be effective immediately upon posting of the revised Privacy Notice, and your continued use of our Services will be subject to the then-current Privacy Notice. We encourage you to review this Privacy Notice frequently to be informed of how we are protecting your information.    

You are responsible for periodically visiting our Website and this Privacy Notice to check for any changes. We always indicate the date the last changes were published; additionally, in the event of a material change to this Privacy Notice, we will provide a more prominent notice of the change.
